1. Introduction

Welcome to HarareBiz (https://hararebiz.co.zw/).

By accessing or using this platform, you agree to comply with and be legally bound by these Terms and Conditions.

HarareBiz is an online marketplace directory that connects customers with independent suppliers, retailers, and service providers in Zimbabwe.

2. Nature of the Platform (VERY IMPORTANT CLAUSE)

HarareBiz operates strictly as an intermediary platform.

  • We do not sell, supply, store, inspect, or deliver any goods or services
  • We are not a party to any transaction between users
  • Any agreement entered into is strictly between buyer and seller

👉 This aligns with how marketplaces operate: they only provide the platform, not the transaction itself

3. No Liability Disclaimer (CORE PROTECTION)

HarareBiz shall NOT be liable for:

  • Any loss of money, fraud, or scams
  • Poor quality, defective, or counterfeit goods
  • Misrepresentation by sellers
  • Non-delivery or delayed delivery
  • Payment disputes between users
  • Personal injury or damages arising from products/services

All users agree that:

“Use of the platform is at your own risk.”

Users must verify sellers before making any payment.

4. User Responsibility

By using HarareBiz, you agree to:

  • Conduct your own due diligence before payment
  • Verify identity, location, and legitimacy of sellers
  • Avoid unsafe payment methods (e.g., unknown mobile transfers without proof)
  • Report suspicious activity

5. Seller Obligations

All suppliers and retailers must:

  • Provide accurate, truthful, and complete information
  • Not engage in fraud, scams, or misleading advertising
  • Comply with Zimbabwean laws, including:
    • Consumer Protection regulations
    • Contract law principles
    • Trade and commerce regulations

Sellers are fully responsible for:

  • Product quality
  • Delivery
  • Refunds and warranties

6. Prohibited Listings

The following are strictly prohibited:

  • Illegal goods or services
  • Stolen items
  • Counterfeit products
  • Weapons, drugs, or harmful materials
  • Fraudulent or misleading listings
  • Adult or offensive content

HarareBiz reserves the right to remove any listing without notice.

7. Payments

HarareBiz:

  • Does not process payments directly (unless stated otherwise)
  • Is not responsible for payment security
  • Does not guarantee refunds

All payments are made at the user’s own risk.

8. Account Registration

Users must:

  • Provide accurate information
  • Be at least 18 years old
  • Keep login credentials secure

HarareBiz may suspend or terminate accounts for:

  • Fraud
  • Abuse
  • Policy violations

9. Platform Rights

HarareBiz reserves the right to:

  • Remove listings or accounts
  • Modify or discontinue services
  • Update these Terms at any time

10. Intellectual Property

  • Users retain ownership of content they upload
  • By posting, you grant HarareBiz a license to display and promote listings
  • You must not post content that infringes others’ rights

11. Disputes Between Users

  • Disputes must be resolved directly between buyer and seller
  • HarareBiz is not obligated to mediate disputes
  • We may assist at our discretion but provide no guarantees

12. Limitation of Liability

To the fullest extent permitted under Zimbabwean law:

HarareBiz shall not be liable for:

  • Indirect or consequential losses
  • Loss of profits or business
  • Data loss
  • Platform downtime

13. Indemnity Clause

Users agree to:

Indemnify and hold HarareBiz harmless against any claims, damages, or losses arising from their use of the platform.

14. Privacy & Data Protection

HarareBiz will:

  • Collect only necessary user data
  • Protect user information
  • Not sell personal data unlawfully
